Terms and Conditions for Waste Collection Roehampton
These Terms and Conditions set out the basis on which Waste Collection Roehampton provides waste collection and related services to residential and commercial customers. By placing a booking, confirming a quotation, or allowing our team to collect waste from your premises, you agree to be bound by these Terms and Conditions.
1. Definitions
In these Terms and Conditions, the following expressions shall have the meanings set out below:
1.1 Service Provider means Waste Collection Roehampton, the business supplying waste collection and related services.
1.2 Customer means any individual, company, or organisation that engages the Service Provider to carry out waste collection or associated services.
1.3 Services means the waste collection, removal, loading, transport, and lawful disposal of waste as agreed between the Service Provider and the Customer.
1.4 Waste means any materials, items, or substances presented by the Customer for collection and disposal, excluding any prohibited or hazardous materials not accepted by the Service Provider.
1.5 Site or Premises means the address or location where the waste is to be collected.
1.6 Agreement means the contract formed between the Service Provider and the Customer incorporating these Terms and Conditions and the specific booking details or agreed quotation.
2. Scope of Services
2.1 The Service Provider offers waste collection and related services, which may include the loading, removal, transport, and disposal of household waste, commercial waste, garden waste, bulky items, and other non-hazardous materials.
2.2 The exact scope of the Services will be specified at the time of booking or in any written quotation provided to the Customer. The Service Provider reserves the right to refuse to collect any item that, in its reasonable opinion, is unsafe, unlawful, contaminated, or not as described at the time of booking.
2.3 The Services are provided within the UK and are subject to applicable waste management regulations and environmental legislation.
3. Booking Process
3.1 Customers may request a waste collection by telephone, email, or through any online booking form made available by the Service Provider.
3.2 When making a booking, the Customer must provide accurate and complete information, including but not limited to:
a. Full name and contact details.
b. Collection address and any access instructions.
c. A clear description of the type and approximate volume or weight of the waste to be collected.
d. Any known special handling requirements or potential hazards.
3.3 Any quotation provided by the Service Provider is based on the information supplied by the Customer. The final price may vary if, upon arrival, the volume, weight, or nature of the waste is different from that originally described.
3.4 A booking is considered confirmed when the Customer accepts the quotation and the Service Provider either sends a confirmation or attends the Site at the agreed time.
3.5 The Service Provider will use reasonable endeavours to attend at the agreed date and time but cannot guarantee specific time slots. Times given are estimates and may be subject to change due to traffic, weather, operational issues, or other circumstances beyond the Service Provider’s control.
4. Access and Customer Obligations
4.1 The Customer must ensure that the Service Provider has safe and reasonable access to the Site for the duration of the collection, including any necessary parking or loading space for vehicles.
4.2 The Customer must ensure that the waste is reasonably accessible, clearly identifiable, and not obstructed by other items. If waste is not ready for collection when the team arrives, additional waiting charges or a failed collection fee may apply.
4.3 The Customer is responsible for obtaining any necessary permissions or permits required for the collection, such as parking dispensations or access authorisations for restricted areas.
4.4 If the Service Provider is unable to carry out the collection due to a lack of access, unsafe conditions, or the Customer’s failure to comply with these obligations, the Service Provider may charge a call-out or cancellation fee as set out in these Terms and Conditions.
5. Waste Types and Compliance with Regulations
5.1 The Service Provider will only collect waste that is lawful to transport and dispose of under applicable UK waste management legislation and guidance, including but not limited to duty of care requirements.
5.2 The Customer must not present any hazardous, toxic, explosive, corrosive, or otherwise dangerous materials unless expressly agreed in writing in advance and subject to any additional charges and conditions. Prohibited items may include, but are not limited to:
a. Asbestos or materials containing asbestos.
b. Clinical or medical waste, including sharps.
c. Oils, fuels, solvents, chemicals, or paint in significant quantities.
d. Gas cylinders, pressurised containers, or explosive devices.
e. Radioactive or highly flammable substances.
5.3 The Customer warrants that all waste presented is accurately described and is safe to handle, transport, and dispose of in the normal course of business.
5.4 The Service Provider will dispose of waste only at appropriately licensed facilities and in accordance with applicable environmental regulations. A waste transfer note or similar documentation may be produced where required by law or upon reasonable request.
6. Pricing, Quotations, and Payments
6.1 Prices for waste collection services are generally based on factors such as volume, weight, type of waste, access conditions, and distance. The Service Provider may provide fixed-price quotations or estimates subject to confirmation on arrival.
6.2 Quotations are normally valid for a limited period, which will be indicated at the time of issue. The Service Provider reserves the right to revise quotations if costs or circumstances change.
6.3 The Service Provider may adjust the price on site if the actual waste volume, weight, composition, or access conditions differ from the description provided at the time of booking. The Customer will be informed of any price adjustment before work begins and may accept or decline the revised price. If the Customer declines and the collection does not proceed, a call-out or cancellation fee may apply.
6.4 Unless otherwise agreed in writing, payment is due immediately upon completion of the collection and prior to departure from the Site. The Service Provider may accept payment by cash, card, bank transfer, or other methods indicated at the time of booking.
6.5 For commercial Customers with approved accounts, payment terms will be set out separately. If no terms are specified, invoices are payable within 14 days of the invoice date.
6.6 If a Customer fails to make payment by the due date, the Service Provider may charge interest on the outstanding sum at the statutory rate and may suspend further services until payment is received in full.
7. Cancellations, Rescheduling, and Failed Collections
7.1 Customers may cancel or reschedule a booking by providing reasonable notice to the Service Provider. The required notice period and any applicable cancellation charges will depend on the type of booking and will be communicated at the time of confirmation.
7.2 If the Customer cancels within a short period before the scheduled collection, or where a vehicle and team have already been dispatched, the Service Provider may apply a cancellation fee or call-out charge to cover costs incurred.
7.3 If the Service Provider arrives at the Site and is unable to complete the collection due to the Customer’s failure to provide access, the waste not being as described, or unsafe conditions, this may be treated as a failed collection. In such cases, a call-out charge or partial service fee may apply.
7.4 The Service Provider reserves the right to cancel or postpone a booking at any time due to reasons beyond its reasonable control, including adverse weather, vehicle breakdown, staff illness, or safety concerns. In such circumstances, the Service Provider will make reasonable efforts to notify the Customer and arrange an alternative collection time. No additional charges will apply to the Customer for a cancellation initiated by the Service Provider in these circumstances.
8. Liability and Limitations
8.1 The Service Provider will exercise reasonable care and skill when providing the Services. However, the Service Provider shall not be liable for minor cosmetic damage to property or surfaces where such damage is inherent in the nature of moving heavy or bulky items, provided reasonable care has been taken.
8.2 The Customer is responsible for protecting floors, walls, driveways, and other surfaces that may be at risk of damage during the collection, and for removing or securing items that could be affected during the process.
8.3 The Service Provider’s liability for loss or damage to property caused by its negligence shall, to the fullest extent permitted by law, be limited to the reasonable cost of repair or replacement of the damaged property, subject to any applicable insurance policy and policy limits.
8.4 The Service Provider will not be liable for:
a. Any indirect or consequential loss, loss of profit, loss of business, or loss of opportunity.
b. Any loss or damage arising from inaccurate or incomplete information provided by the Customer.
c. Any loss or damage resulting from the handling or disposal of prohibited, hazardous, or misdescribed waste.
8.5 Nothing in these Terms and Conditions shall exclude or limit the Service Provider’s liability for death or personal injury caused by its negligence, fraud, or any other liability that cannot be excluded or limited under applicable law.
9. Customer Property and Items Not Intended for Removal
9.1 The Customer must clearly separate and identify any items that are not intended for removal. The Service Provider cannot accept responsibility if items are taken away that were not clearly identified as being excluded from the collection.
9.2 The Customer is advised to check the area after loading to ensure that only the intended waste has been removed. Once waste has been loaded and removed, it may not be possible to retrieve individual items.
10. Data Protection and Privacy
10.1 The Service Provider may collect and process personal information about Customers for the purposes of managing bookings, providing Services, processing payments, and complying with legal obligations.
10.2 Personal data will be handled in accordance with applicable UK data protection laws. The Service Provider will take reasonable steps to keep personal information secure and will not share it with third parties except where necessary to provide the Services, process payments, comply with legal obligations, or with the Customer’s consent.
11. Force Majeure
11.1 The Service Provider shall not be in breach of the Agreement nor liable for any delay in performing, or failure to perform, any of its obligations where such delay or failure results from events, circumstances, or causes beyond its reasonable control. These may include, but are not limited to, extreme weather, strikes, accidents, breakdowns, or acts of government or regulatory bodies.
11.2 In such circumstances, the Service Provider will use reasonable endeavours to resume performance as soon as reasonably practicable.
12. Amendments to Terms and Conditions
12.1 The Service Provider reserves the right to update or amend these Terms and Conditions from time to time. The current version will apply to all new bookings at the time they are made.
12.2 Continued use of the Services after any changes to these Terms and Conditions shall constitute acceptance of the updated terms.
13. Governing Law and Jurisdiction
13.1 These Terms and Conditions, and any dispute or claim arising out of or in connection with them, the Services, or their subject matter or formation, shall be governed by and construed in accordance with the laws of England and Wales.
13.2 The parties agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or the Services provided.
14. Severability
14.1 If any provision or part-provision of these Terms and Conditions is found to be invalid, unlawful, or unenforceable by a court or competent authority, such provision shall be deemed modified to the minimum extent necessary to make it valid, lawful, and enforceable. If modification is not possible, the relevant provision or part-provision shall be deemed deleted.
14.2 Any modification or deletion of a provision or part-provision under this clause shall not affect the validity and enforceability of the remaining terms.
15. Entire Agreement
15.1 These Terms and Conditions, together with any written quotation or booking confirmation, constitute the entire agreement between the Service Provider and the Customer and supersede all prior discussions, correspondence, or understandings relating to the subject matter.
15.2 The Customer acknowledges that they have not relied on any statement, promise, or representation that is not expressly set out in these Terms and Conditions or the written quotation.
By booking or using the Services of Waste Collection Roehampton, the Customer confirms that they have read, understood, and agree to be bound by these Terms and Conditions.
